The Prosper Town Council voted unanimously on Tuesday, Oct. 13, to send a request to rezone two vacant buildings on Business Park Drive back to the town's Planning and Zoning Commission, rather than approve or deny it.

The commission is scheduled to consider the request again at its Nov. 3 meeting, after which it is expected to return to the council. The rezoning remains pending.

The case, ZONE-26-0004, covers about 2 acres on the west side of Business Park Drive, roughly 1,095 feet south of First Street. The owner asked to change the zoning from agriculture to a planned development so the two existing buildings, totaling about 18,537 square feet, could be used for commercial and light industrial businesses, according to the town staff report.

The Planning and Zoning Commission voted 5-1 on Sept. 15 to recommend denial, as [we reported before Tuesday's meeting](https://prosperweekly.news/article/planners-voted-5-1-against-light-industrial-zoning-for-two-vacant-buildings-on-business-park-drive-council-decides-tuesday). Commissioner Butler voted against the denial recommendation, and Chair Damon Jackson was absent. Town staff recommended approval, saying the plan allows use of the existing buildings while securing land for a wider Business Park Drive.

Under the proposal, allowed uses would include offices, office-showrooms, office-warehouses, a small print shop, indoor repair services and limited assembly and manufacturing. Major auto repair, a contractor's shop and an indoor gun range would each need a separate specific use permit.

The buildings could stay as they are, with no expansions. The owner would give the town about 30 feet of right-of-way for the future widening of Business Park Drive and resurface the road with temporary asphalt. If the road is not brought up to current standards within 10 years, the owner would have to rebuild it at the owner's expense, according to the staff report.

The plan includes 51 parking spaces, a 20-foot landscape buffer along Business Park Drive and a dry detention pond maintained by the owner. The site does not border land zoned for homes, and the town had received no responses to its public notice as of the staff report.
